In the former studies, “Iran’s history” is inversely applied in order to explain the present situation of society. Instead of interpreting the determining social structures in the history, such studies attempts to understand “contemporary Iran”. Furthermore, applying comparative-fundamentalist method, they base their analysis on the economic or political conditions of the matter. However, the present study claims that the general theory of social transformation –either the Marxian or Weberian- -that is produced approaching western medieval societies- could not explain roots of disorder and anarchy in Iran. Instead, applying a structuralist model, and focusing on “articulation” in analysis, the present study aims to explore the historical obstacles against the order of law in the history of Iran (rather than western medieval history). Thus, it claims that the main root of “disorder in the history of Iran” is the governing system of political, martial, and economic management in Iran. این مقاله با رویکردی کلان‌نگر ناظر بر تحلیل شرایط ساختاری ـ تاریخیِ «امکان و امتناع قانون و نظم در ایران» است. غالباً تبیین‌های ارائه‌شده از علل تاریخی غیبت قانون و نظم اجتماعی در تاریخ و جامعه ایران، با نگاهی غایت‌شناختی، به دنبال شرح موانع «کنونیِ» غیبت قانون در جامعه ایران هستند. در این انگاره، «تاریخ ایران» در خدمت فهم شرایط کنونی جامعه ایران و به شکل وارونه مفهوم‌یابی می‌شود. شناخت ناشی از این «تبیین‌های تاریخی»، به جای آنکه در راستای تفسیر ساختارهای حاکم بر جامعه ایران در گذر تاریخ باشد، دغدغه فهم «ایران معاصر» را دارند. به علاوه، تحلیل‌های مذکور علت‌های غیبت قانون و نظم مبتنی بر آن را با روشی مقایسه‌ای و با رویکردی بنیادگرا (با تأکید بر بنیان اقتصادی یا سیاسی) تبیین می‌کنند. مقاله حاضر مدعی است کاربست تئوری عام تغییر اجتماعی (چه نوع مارکسیستی و چه نوع وبری آن)، که با محوریت تاریخ غربِِ میانه تولید شده است، توان تحلیل غیبت تاریخی قانون و موانع استقرار آن در تاریخ ایران را ندارد و میان عناصر تشکیل‌دهنده تبیین‌های مذکور و واقعیتِ «عدم استقرار قانون در تاریخ ایران» ارتباطی وجود ندارد. در مقابل، این مقاله سعی دارد با الگویی ساختارگرایانه غیبت تاریخی قانون در جامعه ایران را با محوریت مفهوم «مفصل‌بندی» در تحلیل و در ساختارهای اجتماعی، سیاسی و اقتصادی جامعه ایران (و نه غرب میانه) جستجو کند. مقاله حاضر مدعی است علت بنیادین «عدم استقرار قانون در تاریخ ایران» نوع مدیریت سیاسی، نظامی و اقتصادیِ محدوده سرزمینی ایران است. http://www.jicr.ir/article_138_013d407166ec4fa56eb1e1f8cbe183b9.pdf
